Grant Gross, IDG News Service Thursday, September 16, 2004 Infineon Technologies, a German manufacturer of DRAM (dynamic RAM) has agreed to plead guilty and pay a $160 million fine for attempting to fix prices in the DRAM market, the U. ...
- The DOJ charged Infineon with violating the Sherman Antitrust Act by conspiring with unnamed DRAM manufacturers between July 1999 and June 2002 to fix prices on DRAM sold to computer and server vendors.
- Under the plea agreement, which must be approved by the court, Infineon has agreed to cooperate with the DOJ in its ongoing investigation of other DRAM manufacturers. Robert LeFort, president of Infineon North America, says he couldn't comment on whether he expected other DRAM manufacturers to face similar charges.
- -- Participating in meetings, conversations, and communications with competitors to discuss the prices of DRAM to be sold to certain customers;.
- -- Agreeing to price levels of DRAM to be sold to certain customers;.
- -- Exchanging information on sales of DRAM to certain customers, for the purpose of monitoring and enforcing the agreed-upon prices.
- Infineon's guilty plea follows years of allegations about DRAM price-fixing. The DOJ began investigating DRAM price fixing in 2002, and in May, Rambus filed an antitrust lawsuit against four companies, including Infineon, accusing them of banding together to eliminate competition.
- The Rambus suit was filed in the Superior Court for the State of California against Infineon, Hynix Semiconductor, Micron Technology, and Siemens, and alleged that executives from those four memory vendors colluded to set cost parameters for Rambus' RDRAM (Rambus DRAM) product and to restrict output of that product in order to raise its price and kill its chances of becoming a mainstream memory technology.

- Introduction Has the DRAM sector become a different animal? The Rambus and anti-trust litigation over who owns what patents will likely linger in U. ... Mainstream DRAM applications are now hardly just about the PC sector and now include digital cameras, phones and other devices. But according to leading DRAM vendors we contacted, including representatives from Infineon, Micron and Samsung, not much has changed. DRAM's near- to mid-term development still remains firmly tied to Intel and AMD's PC chipset roadmaps and Jedec development efforts. ... "The guys who have the roadmap for the development of chipsets in their hands are more or less directing the DRAM guys. The DRAM guys are locked into the chipset development roadmap and they must be ready at the launch date of the new chipsets and platforms. " The kind of DRAM that will be available during the next few years will also follow Jedec's traditional development cycle and efforts. "You can love or you can hate Jedec, but it is the only platform where all of the DRAM developers, future users and the main enablers, AMD and Intel, sit together," Weidlich said. ...
- Some of the memory makers' counter claims involve how Rambus allegedly failed to disclose that it held patents for memory technologies it contributed to Jedec DRAM development efforts. Many have pondered how, if at all, disclosure rules for Jedec's DRAM development efforts would change. Rambus' new round of lawsuits last month for DDR2, GDDR2 and GDDR3 underscored the necessity, at least in theory, to examine the disclosure rules for patent ownership when OEM, chipmaker, and memory supplier engineers get together to develop the next-generation DRAM memory standards. ... " Indeed, the memory suppliers who commented on the litigation said there was little or no connection between the ongoing DRAM patent court battles and Jedec DRAM research efforts. ...
