- In July of 1999, Disability Rights Advocates, an Oakland-based non-profit law center, filed a lawsuit in federal court on behalf of an individual with a physical disability, as well as other disability groups, to challenge Educational Testing Service's practice of flagging test scores taken with extended time accommodations. This lawsuit encouraged all testing organizations to re-examine their policies on flagging test scores. The surveys in this study were completed after the lawsuit was filed, but before any testing organizations announced their intentions to stop flagging tests taken with extra time accommodations. ETS discontinued the practice of flagging for the accommodation of extended time on the Graduate Record Examinations, the Graduate Management Admission Test, the Test of English as a Foreign Language, Praxis, and many other standardized admission tests administered as of October of 2001. Shortly after ETS announced this change, the College Board convened a Blue Ribbon Panel to examine the issue of flagging scores taken with an accommodation of extra time. Based on the panel's recommendation, the College Board announced it would discontinue the practice of flagging test scores in October 2003. Within a month of the College Board's decision, ACT announced it would also discontinue flagging in October 2003. ...
